Bayside Park Driver Did Not Go To Jail Quietly

By now everyone has most likely seen the video from Nervous Nellie’s capturing 34-year old Janel Schoenherr driving through Bayside Park last Friday night. Luckily nobody was hit. The Lehigh Acres resident was charged with drunk driving.

Multiple videos show Schoenherr turning right in front of Nervous Nellie’s, taking out two benches against the wall, that luckily nobody was sitting on. She then drove across the Bayside Park grass and into the Snug Harbor restaurant tiki hut seating area.

Bystanders kept her from moving the vehicle any further until the Lee County Sheriff’s Department arrived and arrested Schoener for DUI.

Lee County Sheriff’s deputy Ty James was responsible for transporting Schonherr to the Lee County jail. During the ride to jail, Schoenherr slipped out of her handcuffs. Deputy James stopped his patrol vehicle near the intersection of San Carlos Blvd and Broadway St. to re-handcuff her. Schoenherr was pulled out of the vehicle where she tensed up and was balling her fists, according to her arrest report. To avoid any injury, Deputy James escorted Schoenherr to the ground to her stomach. While on the ground, Schoenherr continued to tense up and tucking her arms underneath her body. Schoenherr’s arms were pulled out from under her body and behind her back. Deputy James used “pain compliance techniques” on her arms by moving her arms up in order to safely apply the handcuffs. While Schoenherr resisted on the ground, she screamed that she was being hurt during the incident. Handcuffs were put back on, checked for tightness, and double-locked. Deputy James continued transport to the Lee County Jail. Schoenherr was checked by the jail nurse, was in good health, did not have any injuries, and did not complain of any injuries.

Cash bond was set at $500 on the DUI charge, $1,000 on the DUI-property damage charge and another $500 for the resist/obstruct ion charge. Schoenherr was released shortly after her arrest and is scheduled to appear in court on September 9th.

My Father was a Washington DC MPD police officer for 26 years and I can remember, as a kid, Dad coming home from his shift with cuts and abrasions on his face and bruises on his arms from prisoners resisting arrest. Some of his most violent encounters were with female prisoners. It is not the job of a law enforcement official to fight with good citizens who break the law; in my opinion, Deputy James should have tased her and then cuffed her.

    • She refused to submit a breath sample, so her BAC is unknown.

      Under implied consent, that refusal will result in increased penalties if found guilty. Some states automatically suspend your license for a year if you refuse to submit a breath sample.
