The request has to do with the Writ of Certiorari case a group of Fort Myers Beach residents (Protect FMB) have filed against the town to have the Town Council take another look at the approval of the Seagate/Red Coconut property redevelopment project.
As we reported back on June 27th, Circuit Court Judge Michael McHugh gave the town 30 days “to file a response showing cause as to why the requested relief should not be granted.” That deadline is Thursday.
In a court filing Wednesday, attorneys for the Town of Fort Myers Beach and Seagate have asked McHugh for a one week extension. They say it’s not a delaying tactic and have gotten the OK from Protect FMB for extra week.
Once the town and Seagate respond, the residents who filed the Writ of Certiorari back in March will have 30 days to respond.
Seagate is planning to redevelop the former Red Coconut property with 5 buildings, including two 17-story structures. The height of the buildings has divided the community that was incorporated in the mid-90’s to stop tall buildings from being constructed.
The developers who over paid for all this property knew the zoning restrictions When they bought the property. I don’t understand why the town would give any variances. 2 17 story buildings is ridiculous.
if the comp plan was written to stop tall buildings ( I did not read it but enough people say this) its very bizarre how this was approved for minimal public gain. I cans see why suspicions are hi on if council men or women are on a take. I dont have a position but lots of people feel pretty strong on this.
